A Delhi court has allowed cheating and criminal conspiracy proceedings to continue in the M3M land dispute over an alleged unpaid consideration for a Gurugram land exchange. The court separately set aside cognisance of a criminal breach of trust allegation.
Key Takeaways
- The court directed the magistrate to proceed expeditiously on the remaining allegations.
- M3M says no charge has been framed and no trial ordered.
- The parties were directed to appear before the Chief Judicial Magistrate on October 27, 2026.
M3M land dispute ruling
In an order dated October 17, 2026, Principal District and Sessions Judge Anju Bajaj Chandna declined to interfere with proceedings against M3M India, its subsidiary companies and several individuals under Sections 420, 120B and 34 of the Indian Penal Code.
The case concerns allegations that the agreed consideration for a land exchange was not paid. The judge set aside cognisance under Section 406, finding that the essential elements of criminal breach of trust, particularly entrustment of property, were not made out.
M3M disputes setback characterization
M3M rejected descriptions of the order as a setback. It said the court made no finding against it on the remaining allegations and that its arguments should be considered when the magistrate hears both sides on charge or discharge.
The developer said the exchange deeds were executed between land-owning companies belonging to Emaar and M3M group companies, not with MGF Developments. M3M also said the consideration, with interest, had been deposited in court in separate civil proceedings between the parties.
The company said it would present those facts to the magistrate and pursue available legal remedies.
