Tamil Nadu resignations by six former AIADMK legislators will stand after India’s Supreme Court dismissed a petition challenging their departure from the state assembly and subsequent move to TVK. The legislators had defied their party’s whip before resigning.
Tamil Nadu resignations challenge rejected
On October 26, 2026, a three-member bench declined to interfere with a Madras High Court order that had dismissed advocate K Suthan’s petition. The bench comprised Chief Justice Surya Kant and Justices Joymalya Bagchi and V Mohana.
The former legislators subsequently joined TVK, the party of Tamil Nadu Chief Minister C Joseph Vijay. During the hearing, the bench observed that someone resigning and becoming a minister was part of the political process.
What the petition sought
The petition sought measures to prevent elected representatives from circumventing anti-defection law by resigning and then joining another party. It also proposed requiring legislators who voluntarily resign and contest by-elections to deposit an amount equal to the public expenditure on those polls.
Justice Bagchi said the police complaint registered over allegations surrounding the legislators’ crossover should be investigated and that the law would take its course. The court’s dismissal of the petition is separate from that investigation.
