India’s Supreme Court has given rival Trinamool Congress factions more time to complete their filings before the Election Commission in the TMC symbol dispute, which concerns the party’s name and its flowers-and-grass election symbol.
Key Takeaways
- The Democratic Trinamool Congress has 10 days to file its response and supporting documents.
- Mamata Banerjee’s faction has a further 10 days after that response to file its rejoinder.
TMC symbol dispute filings
A bench led by Chief Justice Surya Kant granted the extension after hearing lawyers for the two factions. Kalyan Banerjee, representing the Mamata All India Trinamool Congress, said the rival group had not filed the required pleadings.
K Parmeswar, representing the Ritabrata Banerjee-led Democratic Trinamool Congress, said Dussehra festivities had prevented the group from obtaining non-judicial stamp papers needed for some documents. The court said either faction could challenge the admissibility of documents submitted by the other.
Names and symbols remain under review
On September 28, 2026, the court directed the Election Commission to decide the dispute within four months. The case arose from former West Bengal Chief Minister Mamata Banerjee’s challenge to the commission’s decision to freeze the All India Trinamool Congress name and symbol.
In an interim decision on September 17, the commission barred both factions from using the disputed name and symbol pending a substantive determination. It assigned the Mamata faction the football player symbol and the Democratic Trinamool Congress the envelope symbol.
